This is after the party’s disciplinary panel gave him more time to prepare for his defense against being removed from power.
The development marks another delay in what appeared to be a crucial moment for the Nairobi senator, as ODM considers its next move amid internal tensions.
How did Sifuna survive the expulsion?
Sifuna, who was expected to appear before the committee to answer eight charges, managed to push for more time, saying that the process did not give him a fair chance to respond.

His legal team, led by senior counsel Isaac Okero, wrote to the party raising concerns about the procedure and schedule.
A disciplinary panel, appointed by the National Executive Committee (NEC), had met with express authority to decide Sifuna’s fate after he failed to respond to an earlier notice and avoided appearing on the schedule.
However, instead of proceeding with the expected removal, the panel decided to extend the time following an official request from Sifuna’s legal team.
ODM CEO Oduor Ong’wen confirmed that the panel considered a two-part request seeking more information on the charges and additional time to respond.
“The panel allowed the request, and the new instructions, including the timetable, will be presented to Senator Sifuna in due course,” he said.
The move halts disciplinary proceedings, giving Sifuna valuable time as she prepares to defend herself.
What argument did Sifuna make about his case?
In a letter addressed to Wanga, Sifuna’s lawyer said that the disciplinary process was flawed from the beginning.
He said that although the NEC had passed a resolution to remove Sifuna as Secretary General, there was no corresponding resolution authorizing disciplinary proceedings.
“The ODM National Executive Committee (NEC) passed a resolution “to remove our client as the party’s General Secretary.” No Resolution was issued to institute proceedings against him as claimed,” Okero said.
Okero further demanded access to important documents, including the party’s code of conduct detailing the charges and specific resolutions supporting the action against his client.
He also questioned the evidence that the party intends to rely on, noting that the piece of news referred to, linked to the episode of Citizen TVcould not be reached and should be provided accordingly.

Apart from the documents, the defense strongly criticized the schedule provided by the union, saying that the show cause notice was issued on April 2 at 4 pm, just before the Easter holiday period.
The lawyer said that such a window cannot be considered fair or sufficient to prepare a defense for serious claims.
“You served our client with a Show Cause Notice on April 2, 2026 at 4:00 pm. No doubt you knew that the Easter weekend was April 3, 4, 5 and 6, 2026. In fact, if you want him to respond within two (2) days… Two (2) days cannot be described as a full, fair and impartial time to respond to the Charges,” Okeros said.

Sifuna has remained in office despite initial indications that the party leadership was ready to cut ties with him due to internal disagreements.
His open criticism of some prominent party figures, including Oburu Oginga, has further exposed the divisions within the party.
Some analysts suggest the party may be worried about the political cost of removing Sifuna, while others point to major internal changes, linking Sifuna to a group of vocal leaders, including allies of Raila Odingawho may represent an alternative center of power within the party.
