Raphael Tuju Writes An Emotional Message After Thugs Invaded His Property To Evict Him: “I Have No Power”

According to Tuju, more than a hundred thugs, accompanied by a security company, illegally entered his Dari Business Park, now home to Tamarind Cafe, in an attempt to evict him.

“If they had valid eviction orders, they would not have needed to come with thugs. Fortunately, after the chaos they caused, my people informed the Karen Police Station who came to restore order,” Tuju said.

He described the incident as serious and accused those involved of illegal threats.

“I am overwhelmed by the heroic attempt to take possession of my house by force. This is a serious threat, and I will resist it,” Tuju said.

Why is Raphael Tuju surrounded?

Tuju’s problems stem from a long-term dispute with the East African Development Bank (EADB) regarding a loan originally taken in 2015 for 9.3 million dollars (approximately KSh 1.2 billion).

Due to increased interest and penalties, the debt has reportedly increased to KSh 4.5 billion.

The conflict has escalated after several court decisions, including the High Court and the Supreme Court, dismissed Tuju’s appeals to block the auction of his properties, which include Entim Sidai Wellness Sanctuary, Tamarind Restaurant, and Dari Business Park.

Tuju’s legal team claims that some parties may have violated court orders by transferring property titles despite ongoing cases.

The former leader of the Jubilee party expressed his displeasure with the court, claiming corruption and the interpretation of his constitutional rights.

“I do not want to talk in detail about the corruption investigation being carried out by EACC following the arrest of four people including a former High Court Judge who had the courage to come to my premises to take bribes on Monday, March 9. These people had contacted me for several weeks allegedly working for a female judge. There are details of my meeting that I cannot discuss before the investigation is completed,” Tuju said.

According to Tuju, he was denied the constitutional right to appeal after the decision went against him. He added that his lawyers are adjourning the case, which is scheduled to be mentioned in the Court of Appeal on March 16.

Is the East African Development Bank facing a criminal case in court?

Tuju further claimed that the ongoing criminal case against EADB is currently pending at the Nairobi Magistrates Court.

The former Cabinet minister claimed that the bank had used legal tactics to delay the case for more than a year, allowing individuals involved in the disputed transactions to “harass me and come with thugs to drive me out of my premises.”

He added that the bank’s lawyers relied on the request for diplomatic immunity, which he claimed does not apply in criminal matters, despite the Ministry of Foreign Affairs confirming the position of the Vienna Convention to the Supreme Court.

Tuju also accused EADB’s Kenyan country manager of submitting affidavits that were allegedly amended by a lawyer, describing the documents as invalid and meaningless. He said the claim has been strongly supported through affidavits and oral presentations in court.

What did Tuju say while being fired?

Reflecting on the ordeal, Tuju expressed gratitude for the public’s support.

“This has been a long-term dispute with some corrupt people in the bank (EADB) who made unethical demands from me and when I refused, they started a mission to confiscate my family’s assets, no doubt with the cooperation and support of many corrupt lawyers, court officials and auctioneers,” Tuju said.

“Everything we are witnessing now is best described by a Tanzanian saying. The noise of a thief. Once again I am grateful for your prayers and messages of encouragement. God continues to see me and my family through this difficult journey,” he added.

Earlier on Wednesday, Tuju warned that anyone trying to take his property would have to “kill me first and arrange a big funeral for me in Rarieda” before they succeed.
