A woman is jailed for 6 months for refusing to marry a man who paid her school fees

A woman identified as Fortunate Kyarikunda has been sentenced to six months in prison for breaking her promise to marry a man who sponsored her education.

Fortunate can only be released if he pays the man, identified as Richard Tumwine, the amount of USh 14,099,100 (approximately KSh 491,407), which includes the money he used to pay for his studies as well as the fine imposed by the court.

The court ordered that he be detained in the Rukungiri State Prison in the country Uganda until the refund and court costs are paid.

Rukungiri First Class Magistrate, Dianah Nekesa, gave the decision on March 10 after finding that Kyarikunda broke her promise to marry Tumwine.

“Take and receive the said Kyarikunda Fortunate in the civil prison and hold him there for a period not exceeding six months or until the sentence order is fully implemented at the earliest,” part of the arrest warrant says.

Did Fortunate promise to marry Tumwine?

According to a Daily Monitor report, the young woman met Tumwine, a primary school teacher, in 2015 when she was on teacher training at Kiringa Primary School in Kanungu District.

In 2018, the two entered into a prenuptial agreement, which bound Fortunate as long as Tumwine continued to fulfill his promise to fund her education.

When he expressed interest in studying for a diploma at the Law Development Center in Kampala, Tumwine agreed to pay the required fee, which totaled USh 9.43 million, fulfilling his promise to her.

After finishing his studies, the two began to plan an official ceremony to introduce him as well as a wedding, but allegedly Fortunate began to hesitate.

The ceremony was scheduled for February 2022, but he finally pulled out, refusing to marry Tumwine according to their agreement, claiming that he was too old.

Did Tumwine involve the family to solve the marriage promise case?

At first, Tumwine believed that he was just worried, so he involved local leaders, relatives and friends to mediate between them, but all efforts failed.

He then opened a civil case in the Kanungu Chief Magistrate’s Court on 1 July 2022 through his lawyer Erasmus Nabimanya.

During the trial, Kanungu First Class Magistrate, Asanasio Mukobi, ruled that Fortunate broke his promise and ordered him to return USh 9.43 million spent on his education, in addition to paying USh 1 million as compensation for inconvenience and psychological pain.

Fortunate filed a petition seeking to overturn the decision, claiming that he did not properly receive the subpoena.

However, the court rejected his application after he and his lawyer failed to appear to defend it.

Getrude Yohana said Ramadhani left her despite her having paid about TZS 3.5 million (KSh 169,113) as tuition fees.

It is alleged that Ramadhani began to despise Getrude after finishing school, claiming that he no longer wanted to live with her.
