He allegedly beat Faith Jemutai and causing physical injuries. Jemutai is the sister of Eunita Kibor, who is the fourth wife of the deceased.
How the judge of Eldoret reached a decision in the case of Albert Kibor
Eldoret Resident Magistrate, Peter Areri, gave the sentence on Wednesday, March 11. The judge did not allow him to pay a fine as an alternative to imprisonment.
According to the court, the prosecution presented sufficient evidence that led to the finding of guilt.
He was accused of committing the offense on March 8 in the central area of Eldoret town in Turbo sub-county.
In his defense, Albert, who was represented by lawyer Maina Maathai, asked the judge to judge him with mercy, saying that he has never committed any crime before and that this charge of assault is the first in his life.
He told the court that he has a wife and children who depend entirely on him for their needs, warning that his imprisonment will leave them suffering without his support.
He also told the Assistant Chief Magistrate about his mother’s illness, saying that he is the one who takes care of all her medical expenses and her daily needs.
How Faith Jemutai presented her case against Albert Kibor
Jemutai explained to the court how Albert, together with another man, attacked him in the Kibor building, where his older sister had hired him as the caretaker of the building worth millions of pesos.
He testified that Albert invaded the building and confronted him wanting to know why he was managing his late father’s property.
The family has been in dispute regarding the property of the deceased, and on the day of the incident, Albert went to the building threatening to evict the tenants whom he accused of paying rent to Eunita against the court order.
Jemutai, who was the caretaker of the building, told the court that he suffered head and body injuries during the attack by Albert and another man.
“They hit me and dragged me to the floor with force. They even pulled my braided hair and caused me severe pain,” said Jemutai, who submitted the hair along with a torn jacket as evidence.
He said Albert wanted to evict him and the tenants despite the fact that he was innocent.
However, Albert denied the charges claiming evidence was presented to trap him and implicate him in the crime.
At one point, the court allowed mediation between Albert and Jemutai, but they failed to reach an agreement, leading to a full trial.
After the verdict, Albert told reporters that his lawyers will file an appeal against the decision.
When did Jackson Kibor die?
Jackson Kibor died in March 2022, leaving an estate estimated to be worth billions of shillings.
His two wives and more than 20 children contested the validity of his will claiming it was forged.
