High Court Orders IG Kanja, DCI Boss to Bring Missing Busia Businessman: “Dead or Alive”

The High Court has issued an order compelling the Inspector General of Police, Douglas Kanja, and the head of the Department of Criminal Investigation (DCI), Mohamed Amin, to reveal the whereabouts of the missing businessman, Ahmed Mohamed Ibrahim.

Justice William Musyoka issued the order on Thursday, February 5, following an application filed by Busia senator Okiya Omtatah.

The ruling, a writ of habeas corpus, compels police chiefs to produce Ahmed before a court or to provide sworn affidavits detailing his arrest, detention, or current whereabouts.

Court documents detail that the defendants must explain the circumstances of Ahmed’s disappearance, name the officers involved, and show the locations where he was held or transferred.

According to the order, the affidavit must be submitted within 24 hours, failing which the court can take further action.

“The defendants jointly and individually present before this honorable court the body of Ahmed Ibrahim Mohamed, whether alive or dead and show the legitimate reasons for his arrest, detention or continued detention. That, by not presenting, the Defendants are obliged to submit an affidavit within 24 hours, fully, truthfully and personally describing the arrest of Ahmed Ibrahim Mohamed, the officers involved and their command structure, where he was detained or transferred, where he is now, his condition or fate,” read Judge Musyoka’s order.

How did Ahmed disappear?

The order comes amid allegations that 25-year-old Ahmed, a prominent fish trader and cross-border investor, was forcefully removed from a bus while traveling to Nairobi on the night of Sunday, January 25.

According to family members, the bus was stopped at Korinda, opposite the local prison, about 30 minutes into the journey.

They revealed that four individuals, reportedly two men and two women, allegedly demanded that Ahmed wake up.

“Ahmed hasn’t disappeared; Ahmed was made to disappear. Ahmed was on a bus called Buscar. While he was traveling at around 9pm, after about 30 minutes he was ordered off the bus at Korinda, opposite the prison. The people who removed him were DCI officers, two men and two women,” cried his brother, Abdi Hassan.

The case has sparked protests in Busia town, with hundreds of traders and residents demanding answers to the young man’s disappearance.

Many voiced anger that Ahmed, who was carrying large sums of money for fish trade payments, allegedly had KSh17.5 million in US dollars.

His family further appealed to the police to explain where the money went, adding that a previous case of disappearance was never solved.
