A police officer, Eric Gitonga, was arrested on Sunday, September 7, after allegedly shooting motorcyclists following a minor accident. His Audi car was later burned.
Gitonga was brought to court on Monday, September 8, when the prosecution asked permission to hold him for more days.

In a decision decided on Tuesday, September 9, by Kiambu Chief Justice, Elizabeth Karani, the court directed Gitonga to remain in the Kiambu police block, but only for a short time to allow investigators to complete the key aspects of the shooting.

Gitonga’s representative, Philip Langat, opposed the request, claiming that the Constitution required the suspects to be brought to court within 24 hours unless adequate reasons were issued.
He said his client had not disrupted the case and was ready to cooperate on bail.
The court recognized that the prosecution certification had expressed intention to record information, to return the crime, take weapons for scientific investigations, and conduct their deaths.
