However, counting 90 days from the announcement of the post ends that period too early, thus making the election date out of time set by the Constitution.

Article 101 (4) (b) of the Constitution requires the IEBC to hold a minor election within 90 days after the vacancy is announced by the Speaker of the House of Representatives.

Advocate and Senator of Nairobi Edwin Sifuna He was the first to criticize the IEBC.

“The Constitution is clear that a small election must be held within 90 days after the vacancy. But this commission has started poorly in violation of the law clearly,” The senator said.

Others including former Attorney General Justin Muturi, Advocate Kibe Mungai, Makueni Governor Mutula Kilonzo Jr., Makueni Senator Daniel Maanzo and Advocate David Ochami argued that the time announced by the IEBC is not in line with the Constitution.

“It is impossible for a commission formed on the basis of respecting the law to start in violation of the Constitution, they seem to not even know how they decided on that date, this is a plan to delay the cases of removing the sitting MPs, we look at them from a distance,” Said Muangai.

“The constitution is unchanged. The election term is not changed. If they allow this small matter today, tomorrow the presidential election will be delayed for 15 days. They are wrong,” Said Governor Mutula.

Senator Maanzo warned that the move would probably cause the whole election process to be declared invalid in court.
