David Mokaya: A college student says a fake public case about Ruto is undermining his studies

David Oaga Mokaya, a fourth year student at Moi University, faces charges associated with a social network post that contained a picture of a funeral caravan.

The photo showed a coffin covered in the Kenyan flag, surrounded by military officers dressed in festive clothing, accompanied by details: “Ruto’s body is leaving Lee Funeral Home.”

In front of the court on Thursday, July 31, Mokaya, through his attorney Danstan Omarihe requested the postponement of the case until his term of office was completed in mid -September.

The defense claimed that the ongoing legal process interferes with the student’s mental and intellectual studies.

“We ask for a hearing for the case after the university session was completed in the second week of September,” Omari told the court.

During the session, the prosecution presented evidence collected by Boniface Machibi, an online criminal analyst and digital investigations.

He explained that he had received a smartphone and computer processor from the Criminal Investigation Department (DCI) and was responsible for drawing data in connection with the controversial post.

“I received two exhibitions from the headquarters of DCI On November 28, 2024, the Samsung Galaxy A23 phone with a laptop and was asked to provide data related to the post, “ Machibi explained.

How did DCI’s investigation put Mokaya on the crime?

He said that data extraction was done using an investigative tool made in Israel, a Cellebrite version 10.5.0, which is widely used by law enforcement agencies around the world.

According to Machibi, the process started at 10:01:24 am (UTC+3) and lasted 26 minutes and 10 seconds, giving a Gigabiti backup size 1.2.

From the extraction, Machibi said he discovered three profiles on the phone, Boz Gabi (linked to Landlord Ke Landlord Ke), urban trends, and Masillas, and got a screenshot of the controversial post.

On a laptop, he found files in a folder labeled “DVR” and confirmed that temporary seals were similar to the day the image was distributed online.

However, despite effectively restoring the data, Machibi admitted that he could not confirm who owns the equipment or shut down the defendant directly with the published content.

He explained that although digital material seemed to be true, he had not interacted and did not recognize the people involved with the equipment.

Was David Mokaya found guilty?

Omari raised several concerns during the interrogation. He questioned the trust of the evidence, stating that the picture did not clearly state that the President had died.

He also claimed that the post could have been issued by AI and that the prosecution had failed to confirm the ownership of the equipment or establish a clear relationship between Mokaya and the online post.

“The post does not require that the president is dead. It is also likely that the message was delivered by AI,” Said Omari.

He added that there was nothing in the evidence presented that linked Mokaya to the alleged error.

After listening to the controversy from both sides, Judge Benmark Ekhubi accepted the prosecutor’s request to postpone and arrange the next date for the hearing on September 8.

The court is expected to continue to investigate digital evidence and determine if Mokaya was directly involved in the post.

Did Kenyans call for the release of Mokaya?

In March, TUKO.co.ke reported that shortly after the charges were publicly announced, many Kenyans appeared on online platforms to demand Mokaya be released immediately.

Using the railroad #dropdavidmokayacharges, they argued that Mokaya was not a criminal but a young citizen who expressed political disgust.

The movement was quickly gaining momentum, with supporters insisting that the case was excessive and threat to digital freedom.

Despite public pressure, the director’s office said that no formal request was submitted to review the charges.
