A Kibera Court has released three activists linked with mobilising looters and inciting violence during the June 25, 2025, Gen-Z demonstrations.

Magistrate Marcia Kahuya on Wednesday, July 2, 2025, freed John Mulingwa Nzau, alias Garang, Mark Amiani, alias Generali, and Francis Mutunge Mwangi, alias Chebukati, on a cash bail of Ksh200,000.

In her ruling, the magistrate noted that she is not persuaded enough of the existence of exceptional circumstances that would lead the trio to deserve detention as the only avenue towards the path of justice.

“In the interest of justice while having regard to public interest, order, and national security, prayer (d) of the application is allowed; that pending the conclusion of the investigations, it is hereby ordered that the respondents be released on cash bail of Ksh200,000,” Magistrate Kahuya ruled.

Further, she has ordered that the electronic gadgets seized from the three be subjected to forensic examination.

She also directed that the trio report to the Investigative Officer (IO) at the Muthaiga Police Station every Monday and Thursday at 9 AM to assist in investigations.

The Directorate of Public Prosecution (DPP), in a miscellaneous application before a Kibera Court, sought to detain the three for 21 days to enable them to complete their investigations.

However, the defense team vehemently opposed the DPP application, citing that their clients did not commit any offence.

Further, they argued that the three were arrested without any warrants, urging the court to release the trio on a free bond.

“Your honour, the respondents (Mulingwa, Amiani, and Mutunge) did not commit any offence for them to be detained. We urge this court to release them on a free bond,” defense lawyers told the court.

According to Directorate of Criminal Investigations (DCI) officer George Karanja, the three are linked with arson, contrary to Section 332(a) of the Penal Code, Cap 63.

He also stated that they are being investigated on accusations of stealing, contrary to Section 268 as read with Section 275 of the Penal Code, Cap 63.

The officer also stated that the three are linked with housebreaking and burglary, contrary to Section 304 of the Penal Code, Cap 63.

Additionally, the three are being investigated for malicious damage to property, contrary to Section 339(1) of the Penal Code, Cap 63.

The DCI further stated that it emerged that upon learning the extent of the destruction and public outcry following the events of June 25, 2025, the trio attempted to evade arrest by hastily boarding a Mombasa-bound bus.

However, the police managed to intercept the said vehicle at Konza City along the Nairobi–Mombasa Highway, where they were identified and arrested.

According to DCI investigations, it was further revealed that the three were actively involved in the planning, mobilisation, and financing of groups that committed the crimes.

“That preliminary investigations reveal that the respondents were actively involved in the planning, mobilisation, and financing of individuals who infiltrated the demonstrations held on June 25, 2025,” officer Karanja stated.

Notably, they stated that they found a notebook that appears to outline organisational plans and includes mapping of specific areas and individuals suspected of coordinating the infiltration of the peaceful demonstrations through acts of looting, burglary, and indiscriminate destruction of people’s public and private property.

The matter will be mentioned on July 23, 2025, for further directions.
