On Monday, June 16, Mukhwana issued a spectacular statement to the Independent Police Management Authority (IPOA).
In a statement, the arrested officer narrated the incidents that led to Ojwang’s death ‘inside a cell at Nairobi police station.
He alleged that he was instructed by OCS Samson Talam to hire prisoners to “teach him the court” after he was brought in by officials of the Criminal Investigation Department (DCI).
Mukhwana claimed that Talam was carrying out instructions from Kenya’s deputy police chief Eliud Lagat.
However, speaking on Spice FM on June 17, Advocate Danstan Omari called on Kenyans to take precautions about Mukhwana’s statement.
According to Omari, Mukhwana’s statement cannot be considered a direct truth as it has not been officially investigated in court.
“A statement issued by Mukhwana, I urge the country to be careful. The statement has not been investigated in court. IPOA can be told everything, but they must work according to the law,” Said Omari.
He continued to question the direction of the ongoing investigation into the death of the blogger, saying IPOA is using the wrong way in seeking justice.
Omari explained that the correct procedure is to establish an Inquest in which the judge may identify those involved before being charged.
“Where the murder has occurred within the police station, the law through section 358 (6), (7), and (8) of the Criminal Code of Conduct says the court investigation should be conducted. He said.
The voice lawyer went on to say that IPOA has incorporated politics into the investigation, which could allow real killers to escape.
“Politically it is good that the arrest has taken place, it makes the nation monitor. But the fact is that, if the case proceeds in this way, the killers can be released by the Supreme Court on the technical grounds that it was not a true right,” He explained.

He told IPOA that he was pressured by Talam to arrange the attack on the blogger at the police station.
Mukhwana claimed that Talam threatened him and told him that the lower -ranking soldiers would be punished if they opposed it.
He said he gave KSh 2,000 to a prisoner named Ngige to look for other prisoners for the attack, and also bought alcohol as they requested.
