Why were 3 Natembeya partners arrested?
The three are charged with preventing the Ethics and Anti -Corruption Commission (EACC) detectives from carrying out their duties, and destroying five vehicles during the invasion of Natembeya Mountains on May 19.
Two defendants, Sinyereri MP (MCA) John Makhanu and Frank Wabwire, a Protocol Officer in the Governor’s Office, were arrested outside the Mountains Court on Tuesday, June 3.
The third defendant, the former MCA Motosiet Bernard confronted Muganda’s famous BCOOL, arrested by the Criminal Investigation Department (DCI) from his Motosiet residence on Monday, June 2.
They were all presented before the court of Kitale On Wednesday, June 4.
Arriving before Chief Magistrate Samuel Mokua, the three did not accept any counsel after the prosecution asked for an order to detain them as they completed their investigation.
The prosecution, led by John Okoth, told the court that they needed at least ten more days, among others, to make appreciation for the vehicles allegedly destroyed during the raid.
“Sir, we ask that you give us orders to detain the suspects for 10 more days to enable us to complete the investigation, including appreciating the destruction. If they are released before completing our investigation, they can intervene in witnesses,” Okoth told the court.
Kitale Judge criticized the police
However, the court refused to issue such orders on the grounds that the police had no authority to arrest and detain the suspects without sufficient evidence.
“We expect the police to conduct their investigations before submitting the suspects to court,” The judge said.
He released three defendants on bail of KSh 100,000 in cash or a Ksh 500,000 bond.

The court also ordered the prosecution to complete its investigation within the next 30 days.
EACC’s new request against Natembeya
Previously, TUKO.co.ke reported that the EACC had submitted another request to stop Natembeya from reaching all sub -county offices.
The anti -corruption organization has already received orders to prevent the county chief from trampling in his office in Kitale.
However, the EACC, in a recent request, argues that since Natembeya still has the ability to work from sub -county offices, he may continue his investigation.
The former Commissioner of the Rift Valley is facing charges of corruption related to allegations of fraud, office abuse and bribery in KSh 1.4 billion county projects.
