The Ethics and Anti -Corruption Commission (EACC) is now seeking to increase the sanctions imposed by the Court despite the ongoing corruption case associated with Ksh.1.46 billion in public funds.
The EACC commission filed a formal request requiring the court to add bail conditions imposed on the governor who is currently facing criminal charges related to allegations of procurement law, bribery, abuse of office and fraudulent use in the financial year of 2022/2023 and 2024/2025.
According to the oath of Assistant Director of the EACC, Emmanuel Arunga, which TUKO.co.ke gave us an eye, Natembeya is charged with deliberately avoiding court orders for transferring his official duties from Trans Nzoia County Headquarters to be banned to the suburbs of the minority county.
“After a request on May 20, the first defendant (Natembeya) was released on bail on conditions including being prevented from reaching the office of Trans Nzoia County headquarters,” The affidavit said.
EACC wants Natekeeya to be prevented from entering sub -county offices
However, Arunga revealed that a post -case investigation revealed that important documents related to the charges are not only for county headquarters but are also found in various sub -county offices across the region.
“The following investigation of the request revealed that an investigation into the instant charges is more than the main office of Trans Nzoia County to various sub -counties including Kiminini, Saboti, Endebess, First and Cherangany, which each office has an important receipt for investigation,“It studied part of the court reports.
The commission now wants the courts to amend the terms of the bail to prevent Natembeya from reaching all county government offices – headquarters and equivalent counties – until the investigation is completed.
“The Natembeya access to county offices or any county offices will not only interfere with the ongoing investigation but will also affect the criminal case facing him,” The EACC submitted.
“So it is for the benefit of justice that Nateeya should be prevented from reaching not only the county offices as ordered before, but also all sub -county offices,” The affidavit added:

The move follows the misery of March, when EACC officials carried Kitale.
The operation sparked controversy when unknown people invaded the fort and destroyed five government vehicles and removed some of the items.
The EACC has since filed a separate case against people suspected of planning damage during the Kitale operation.
