The famous gospel artiste Alex Nyachonga Apoko alias Ringtone has been charged with conspiracy to defraud contrary to section 317 of the Penal Code alongside his co-accused Alfred Juma Ayora.
According to the charge sheet, Ringtone is said to have conspired with Ayora on February, 2023, to defraud one Teresiah Adhiambo Odhiambo of her land within Nairobi County, valued at Ksh50 million.
“On or before February 28, 2023, at unknown place within the republic of Kenya, jointly, conspired to defraud Teresiah Adhiambo Odhiambo of her land parcel number Nairobi/block 99/142 measuring approximately 0.1908 hectares, valued at Ksh50 million” part of the charge sheet reads.
Appearing before Senior Principal Magistrate Dolphina Alego, at the Milimani Law Court, on Thursday, May 15, 2025, Ringtone pleaded not guilty to the charge.
However, the court failed to release him on cash bail and ordered the Directorate of Criminal Investigations (DCI) to detain him at Capitol Hill until Monday, May 19, 2025, when his application for bail will be determined.
In the second count, his co-accused Juma Ayora is charged with false swearing contrary to section 114 of the Penal Code.
On February 28, 2023, Ayora is said to have lied by taking an oath through S.M. Katonya advocate, that he lived on Adhiambo’s land for two decades a fact he knew was false.
“Before S.M. Katonya advocate, a person authorized to administer oath, you falsely swore in an affidavit upon a matter of public concern to the effect that you resided on a land parcel Number/Block 99/142 for two decades, property of Teresiah Adhiambo Odhiambo,” part of the charge sheet read.
On the same date, Ayora is accused of knowingly giving false testimony touching on the said application of the said land pending before Environment and Land Court, by stating that he resided on it.
Ayora, is said to have given the false information in a judicial proceeding before the Lands Court, case number E012 of 2023 (OS) in which he was the petitioner while Teresiah Adhiambo and the Chief Land Registrar were respondents.
In the third count, Ayora has been charged with perjury, contrary to section 108 (1) (a) as read with section 110 of the Penal Code.
Earlier, Magistrate Alego had issued a warrant of arrest for Ringtone after he skipped a court session in April 2025.
