Nakuru: Five people charged with the brutal murder of Molo activist Richard Otieno have filed a petition calling for the court to order family lawyer Rosalinda Wamaitha not to participate in the case.

Why are Richard Otieno suspects not wanting a deceased family lawyer
Arriving before Magistrate Patricia Gichohi in the Nakuru Law Court on Tuesday, April 8, the defendants, through attorney David Mongeri, claimed that the family's attorney had acted illegally because he contacted them and had information about their understanding of the case.

“The defendants must have their day in court without looking back if someone is looking at their actions,” Mongeri told the court.
They also claimed Otieno's family attorney at one time took orders from the second defendant, Peter Oketch famous Djio, before his arrest.
“There was a disclosure of preferential information, then when he phoned the police and the defendant was arrested. He brought the second defendant to the police, after taking orders from him,” Mongeri said.
But in his defense, Wamaitha said that the request has no validity and is equal to the misuse of the court process.

While asking the court to dismiss the case, the lawyer denied allegations that he met the second defendant and had a long negotiation with him.
“There is no evidence shown before this noble court. The argument that there is an attorney/client's relationship between me is another wrong argument,” Wamaitha presented.
He also said the petition raised serious suspicions, which he described as unmistakable to the deceased's family, especially the wife.
The court will make its decision on the request on Tuesday, May 15.
When was Richard Otieno killed?
Otieno, known as 'President of Molo', was brutally murdered near his home in Elburgon, Nakuru County, on January 18.
He is said to be attacked by unknown people when he returned from watching the Premier League (EPL) match.
His death was linked to his role in defending civil rights and government accountability within Molo sub -county.

Earlier, TUKO.co.ke reported that detectives from the Criminal Investigation Department (DCI) had arrested five suspects linked to the killing of Molo activists.
DCI It listed Geoffrey Mavado, John Ndegwa, and Jorim Ngonga Chapter to be the main suspects.
Others also arrested were Clinton Simuntu and Peter Mwaniki. The two are said to be bodaboda operators who allegedly sent the suspects listed to the criminal area.
