Tuju accused the High Court judge of corruption and formally requested him Martha KoomeChief Justice and president of the High Court of Kenya, intervened.
Speaking outside the High Court premises in Nairobi after handing Koome a letter, Tuju said he had chosen to seek justice through institutions rather than violence amid growing tension over the dispute over his Karen property.
“I came to court today with only a letter and not with gangsters,” Tuju said. “If you allow our country to go the way of thugs, then we will go towards chaos and anarchy, in other words, a failed state.”
Details about Raphael Tuju’s case
Tuju said the letter contained information already in the hands of investigative agencies including the Directorate of Criminal Investigation (DCI), the Ethics and Anti-Corruption Commission (EACC) and the Office of the Director of Public Prosecutions (ODPP).
While admitting that many officers continue to work under difficult conditions, he praised investigators, lawyers, judges and journalists who he said have continued to commit to responsibility.
“I would like to congratulate many brave Kenyans, officers in the DCI, ODPP, members of the judiciary and journalists, many of them working under very dangerous conditions. Some of them have lost their lives by hiring thugs or even the police while trying to do the right thing,” he said.
Tuju also nominated a judge in Machakos, for what he described as a bold decision in a separate case concerning the validity of the EADB Act.
“Judge Esther Maina refused to allow this unconstitutional provision to continue without a full trial,” Tuju said. “I commend him for protecting Kenyan taxpayers’ money.”
Was Tuju asked for a KSh 10m bribe?
However, Tuju made serious allegations against the commercial court judge claiming he was asked to pay a bribe of Kshs 10 million instead of a good decision in the ongoing multi-billion shilling debt dispute.
“For several weeks his agents came demanding money and I refused. Instead of giving this bribe I chose to work with EACC,” Tuju claimed.
He claimed that shortly after the decision, individuals accompanied by what he called “thugs” tried to evict him from his land without a court order.
“What immediately followed was an attempt to evict me from my land… who came with thugs and without a court order to evict,” he said.
Tuju further emphasized that the wider integrity of the court was at risk, claiming the court was in court.
What did Tuju tell the DCI after the raid on his Karen property?
The former Cabinet minister said he will now seek further compensation in the High Court as investigations and related criminal cases involving EADB continue.
