An outpouring of grief erupted outside Milimani Court after a children’s court ordered a grandfather to hand over his five-year-old granddaughter to a man identified as her biological father.

The old man, Tobias Omondi Nyaswa, burst into tears at the court gate, wailing in frustration as he struggled to accept the decision.
Nyaswa told reporters that he and his wife have raised the little girl since she was a baby, following the death of her mother just two months after giving birth.
According to a report by Ghetto Radio, the couple immediately stepped in and took full parental responsibility for the child.
“We’ve been the only parents he’s known,” he said, visibly shaking as he spoke to reporters outside the court.
The grandfather explained that over the years, he and his wife had provided everything the child needed – from food and clothing to daily care and emotional support.
“I have been father and mother to this child,” Nyaswa said with tears in his eyes. “I do his laundry and even change his nappy.”
He also claimed that the deceased’s daughter had the child out of wedlock and she never identified anyone as the father of the child during her lifetime.
Nyaswa lamented that losing custody of the girl to a man who was not present at her birth or early years is a great pain and, in her opinion, unfair.
The situation became more emotional when the child started crying while being taken out. Witnesses said the five-year-old cried a lot and insisted that he did not want to leave his grandparents.
Nyaswa also questioned the court’s decision, claiming the name of the alleged father was not known enough before custody was awarded.
He warned that the court should be responsible if anything happens to the child in the future.
At that time Nyaswa was mourning outside the court, his wife, Lilian Mung’eli, who was arrested earlier along with a small child, were being held in police cells within the Milimani court premises.
He was later released shortly after the child was taken.
As the emotional scenes unfolded outside court, onlookers gathered to witness the harrowing moment, while others tried to comfort the distraught grandfather.
For Nyaswa and his wife, the court’s decision marks a painful change after five years of raising a child who they say has become the center of their lives.
“All we wanted was to raise him well,” he said quietly while wiping away tears. “He’s our son in every way that matters.”
