Magwanga filed a case in the Employment and Labor Relations Court, claiming that the actions were unconstitutional, annulled, and actually removed him from office.
Why is Oyugi Magwanga seeking a court order?
Speaking to an advisory delegation in his East Ward of Kamagak on Wednesday, February 4, Magwanga said he is requesting a court order to reopen his office, restore his staff and vehicles, and prevent further interference with his constitutional rights.

“I went to court to order the governor to open my office which he closed since last year. In fact, he has made me unemployed. I have no place to stay to provide services to the people of Homa Bay. They need those services, and I cannot work from or under a tree,” he said.
Magwanga claimed that since his office was closed in December 2025, there was no direct communication with the governor, nor did he give him any duties.
He expressed regret that despite earning a salary, he has not been able to provide the same service, thus letting down his voters.
“So I want to urge him to make the necessary arrangements to even open the office before the court takes action,” he pleaded.
Amidst the tension, Magwanga reiterated his previous efforts to win the county seat in 2017. In 2022, he suspended his bid to support Wanga by becoming his deputy.

“In 2027, I will be on the ballot as the governor of Homa Bay county. Let him prepare that we will face each other,” he confirmed.
He disclosed that the residents of East Kamagak supported his decision to embark on a journey that would make the county great again.
The deputy governor also accused Wanga of ‘exaggerating the national government projects, calling them his own, but he cannot tell the people of Homa Bay where he has sent about KSh 48 billion to the county since he took office.’
Meanwhile, the ‘enmity’ between Wanga and Magwanga increased in the weeks leading up to the November 27, 2025 by-election, when they supported different candidates for the Kaspul parliamentary seat.
Did Alai advise Magwanga to resign?
In related news, Kileleshwa MCA Robert Alai urged Magwanga to resign after a public dispute with Wanga.
Alai said that Magwanga has no chance of winning the next election and thus resigning would help him save his political future.
MCA claimed that Wanga would strongly oppose his deputy and that Kenyan voters love the winning team regardless of the means of their victory.
