Why did Wamatang’i file a petition in court regarding his property? The destruction occurred amid a legal dispute after Wamatangi moved to court over what he called verbal threats to destroy the property.
In an application submitted to the Milimani Commercial Court, the governor noted that the land in question is owned by Kenya Railways Corporation and that he had been legally staying there for more than two decades.
He claimed that the long-term agreement confirms the existence of a valid and continuous lease, under which he created and operated his business with the full understanding and approval of the government agency.
The petition went on to explain that around December 17, 2025, persons alleged to be officers, agents or employees working on behalf of Kenya Railways illegally visited the property and issued verbal threats of removal.

According to the documents, they indicated that the structures on the land would be demolished by December 22, 2025, or any time thereafter, despite failing to give an official notice to remove or follow the procedures required by law.
Wamatangi claimed in the petition that the threats were a violation of his constitutional rights to property and administrative justice.
