The Speaker of the National Assembly Moses Wetang’ula has officially announced that the parliamentary position has been left vacant following the death of the elected Member of Parliament Denar Joseph Hamisi.

The declaration comes several weeks after the MP’s death, and established constitutional and legal procedures governing vacant positions in parliament.

Hamisi, who was part of the coalition of Kenya Firstdied on Saturday, December 6, 2025, at the age of 56.

His death marked the end of his parliamentary career which saw him contribute to important parliamentary committees and national debates.

In a newspaper notice on January 2, Wetang’ula confirmed that the position was announced in accordance with the constitution and the Election Law.

What happens when a Kenyan Member of Parliament dies or resigns?

According to the Constitution of Kenya, a parliamentary seat is officially vacant when a member of parliament dies, resigns, or is removed from office.

Following such an event, the Speaker of Parliament is obliged to provide information to the public within 21 days, initiating the procedures specified under the election law.

For states with elected representatives, the declaration of a vacant seat usually leads to a by-election, which the Independent Electoral and Boundaries Commission (IEBC) must hold within 90 days to fill the vacancy.

The process is different for appointed MPs. In such cases, there is no by-election.

Instead, the political party that previously nominated the MP must nominate a replacement from the party’s list of candidates that was submitted to IEBC before the recent general election.

Hamisi entered parliament after the 2022 General Election through the nomination of the now defunct Amani National Congress (ANC).

During his tenure in the National Assembly, Hamisi served on the Sports and Culture department committee and was also a member of the National Equality and Equal Opportunities select committee, where he contributed to discussions on unity and inclusion.

How did Denar Joseph Hamisi die?

Wetang’ula confirmed Hamisi’s death shortly after it happened and paid tribute to his character and work ethic, noting his dedication to serving Parliament and the public in general.

Mudavadi also mourned the late MP, describing him as a principled and reliable public servant whose contribution will be remembered.

According to witnesses, Hamisi’s SUV left Nandi Road and entered a ditch and hit a tree, leaving him with serious head injuries.
