“On various days, including but not limited to 30 December 2025 and 3 January, the member who occupied the position of Secretary General of the party has treated the ODM party in clear and arrogant violation of the party’s constitution as read with Section 14 (A) of the Political Parties Act No. 11 of 2012 of the Laws of Kenya,” said part of the petition.

Did Sifuna break the ODM constitution?

The Migori Member of Parliament pointed out that Sifuna should be considered to have directly resigned from ODM after allegedly disseminating the philosophy, interests, or policies of another political party.

According to Oketch, such actions are against the Law on Political Parties, which obliges party officials not to cooperate with or promote competing parties.

Oketch also criticized Sifuna for allegedly breaking ODM’s core values and failing to comply with any valid resolution issued by the party’s governing bodies.

Among the main complaints are Sifuna’s recent statements about secret and internal party matters.

The results, which were made public, have been seen by some ODM insiders as a sign of growing tension within the party following the death of the party’s long-time leader, Raila, in October 2025.

In his petition, Oketch argued that the disclosure of the party’s confidential information has seriously damaged the party’s image and credibility with the public, warning that such conduct undermines the unity and discipline of the party.

Furthermore, he wants the party to begin formal disciplinary proceedings aimed at removing Sifuna from the ODM membership register, which could lead to his complete removal if he is found guilty.
