A man accused of defrauding job seekers by pretending he could get a position in the National Police Service (NPS) has been released on cash bail after appearing before the Milimani Magistrate’s Court.

According to court documents seen by TUKO.co.ke, James Chesimani Masengeli, who is also known as Timothy Khatete Barasa, is alleged to have received KSh 2,588,000 from seven people.
This was after he claimed that he was in a position to guarantee employment in the police service.
The alleged offenses occurred between November 18 and November 23, in an undisclosed location within Kenya.

Why did Masengeli ask for lenient bail conditions?
Prosecutors said Masengeli lied to himself and took money from the complainants knowing full well that he did not have the power or authority to lobby for employment in the NPS.
Accompanied by his lawyer, Masengeli appeared before Senior Chief Magistrate Dolphina Alego, where he asked for lenient bail conditions.
His defense lawyer Shadrack Wambui urged the court to consider the condition of the accused.
“We humbly request that this court consider granting lenient bail conditions to the accused to secure his freedom,” Wambui submitted.
Wambui further claimed that Masengeli was a family man who had no history of breaking the law.
“The defendant is a father of four children, he is a law-abiding citizen. Under Article 50 of the Constitution, we will humbly request that you grant my client bail and bail conditions.”
The defense team is looking for evidence in Masengeli’s case
The defense also asked for full disclosure of the prosecution’s evidence.

“We also request that we be given all the evidence that the government will rely on in this matter. My client has a great desire to try to determine the situation he finds himself in. My instructions are that he is mistaken for someone else and maybe after a while the court will get to the root of the matter and confirm the truth, and defend him against the charges he is facing,” Wambui added.
After considering the submissions, Magistrate Alego granted Masengeli cash bail of KSh 500,000 or an alternative bond of KSh 1 million.
It was not clarified in court if the suspect is related to Deputy Inspector General of Police Gilbert Masengeli.

Was the fake KDF brigadier arrested in Kilimani?
In a related incident, a man who claimed to be a retired Kenya Defense Force (KDF) officer was arrested in Kilimani after allegedly impersonating a brigadier and issuing fake letters of employment to the Ministry of Defence.
Detectives reportedly found him wearing full military uniform during the operation.
Investigators also found several suspected forged documents, including entry letters, call letters, fingerprint forms and a KCSE certificate linked to the victim.
Authorities believe he was distributing the fake documents to unsuspecting Kenyans.
The prosecution told the court that it needed more time to complete the investigation and said that the suspect was a flight risk.
