Nairobi: Father Attends His Daughter’s Wedding at the Last Minute, Presents a Case in Court

  • Francis Ogallo accused his ex-wife of allegedly humiliating him and excluding him from the lives of his children
  • Through lawyer Danstan Omari, he asked the court to stop the wedding until his role as a father is properly recognized

A Nairobi judge today issued a temporary order after a businessman rushed to court and stopped his daughter’s wedding, which was scheduled to take place tomorrow, Saturday, December 6, in Karen.

Milimani commercial court judge Gerhard Gitonga issued the order after Francis Ogallo rushed to court, accusing his ex-wife of allegedly humiliating him and separating him from his children’s lives.

Through a lawyer Danstan OmariOgallo told the court that his case was urgent, saying that he was married to his ex-wife for 32 years but they divorced in 2024.

However, he has accused his ex-husband of organizing a campaign to isolate and humiliate him.

“Respondent has intentionally taken steps to isolate, humiliate, and discriminate against me with malicious intent. His actions violate my constitutional rights as a parent,” he said in court papers.

Where was Francis Ogallo’s daughter’s wedding venue?

The wedding was planned to take place at Suswa Gardens in Karen, but the businessman told the court that his ex-wife had a history of humiliating him during large family events.

He claimed he had previously been excluded from another daughter’s wedding in 2021.

He said that such isolation amounts to emotional abuse under the Protection Against Domestic Violence Act.

“That the actions mentioned by the defendant are based on a history of personal vendetta and slander against the applicant, including spreading bad allegations about the applicant to his employees, co-workers, and members of his church community, all of which have put his reputation in disrepute and in public for no reason. During our eldest daughter’s wedding, he planned events designed to humiliate me in public. Now he has resumed the same conduct,” the court papers say.

Ogallo further told the court that he never refused to participate in the ceremony, except that he preferred not to participate in a ceremony led by special priests due to past conflicts.

“Fearing further embarrassment and irreparable violation of his rights under Articles 27, 28, 33 and 45 of the Constitution, the petitioner is seeking an urgent injunction to prevent the wedding from proceeding without his involvement. Unless this court intervenes, the ceremony will continue and render all these petitions null and void,” Omari, his lawyer, said.

He also claims that the mother of his children misrepresented her views on the election of priests, circulated false allegations about him, and shared her private communications with others to justify her exclusion from her daughter’s wedding.

“That the defendant has now resumed such behavior in relation to the upcoming wedding, despite the applicant clearly stating that he will not participate in the wedding if certain religious people are involved”, the court papers continue to say.

Threats and Slander

In her affidavit, she has further accused her ex-boyfriend of reporting her to the Directorate of Criminal Investigation for alleged intimidation and defamation. He filed a summons dated November 12, 2025, asking him to appear before the RCI Nairobi Area, which was attached to the court papers. He denied all these claims.

The judge issued a temporary injunction to stop the wedding and ordered that it be resolved through family negotiations or mediation.

“That this is a family dispute that should be resolved through family negotiations and/or mediation. That, in the meantime, a temporary restraining order is issued and prevents the defendant, his agents, servants, representatives or any other persons acting at his behest from proceeding, conducting, facilitating or in any other way participating in the planned wedding ceremony of the applicant’s daughter scheduled for Saturday, December 6, 2025, pending the mention of the two parties for further instructions,” the orders were read in part.

Gitonga also directed that the order be submitted to the OCS at the nearest police station for enforcement, with the court attaching a warning that any disobedience will result in legal consequences.
