Can the courts challenge the settlement’s victory?
As previously reported, Samia’s victory is controversial but cannot be disputed by anyone.
According to the Tanzanian Constitution of 1977, Article 41, once the Electoral Commission declares a candidate to have been elected legally, the court has no authority to challenge or examine the results of the election.
This article prevents presidential results through the legal process, thus confirming that the victory of the Settlement is final and irrevocable.
According to the same constitutional article, the president-elect must be sworn in within seven days of his official announcement, unless he prevents the swearing-in due to resignation or death.
