Nairobi – Former Governor of Kiambu Ferdinand Waitituwho is serving a 12-year sentence in Kamiti Prison, has received another major blow in his quest for freedom.

The former governor of Kiambu filed a case in court seeking to reduce his bail of KSh 53.5 million previously issued by the High Court.
Why did the judge reject Ferdinand Waititu’s request?
However, on Wednesday, October 29, the High Court rejected his request, saying Waititu failed to justify changing the conditions he proposed.
According to Judge Lucy Njuguna, Waititu had not provided ‘sufficient grounds’ to change the original conditions, which required him to submit a full bank guarantee.

The judge wondered why the former Kiambu boss wanted the bail conditions to be different, but he was the one who proposed the idea of a bank guarantee.
“The applicant (Waititu) himself offered a bank guarantee, and in order for him to do so, he must have known what it would entail to obtain the guarantee and that he was ready, able and willing to fulfill his part of the agreement to obtain the guarantee. Now he cannot turn around and say that he has not been able to fulfill the conditions of the guarantee,” the judge ruled.
Will Ferdinand Waititu remain in the Committee Prison?
Following the decision, Waititu will now remain in prison serving the 12-year sentence handed down by the judge until his appeal against his sentence is heard and decided.

How Waititu ended up in jail
Waititu’s conviction stems from a long-running corruption case that began with an investigation by the Ethics and Anti-Corruption Commission (EACC) in 2017.
The investigation followed a complaint that Kiambu County had awarded a KSh 588 million contract to Testimony Enterprises Ltd for the improvement of gravel roads in sub-counties. ThikaLimuru, Gatundu North, Juja, and Ruiru.

The politician and his wife had appeared before Chief Magistrate Thoman Nzioki at the Milimani Anti-Corruption Court.
They were convicted based on their charges, which included fraudulent procurement, abuse of office, among other charges against them.
On the charge of conflict of interest, the former governor of Kiambu was sentenced to seven years in prison with an alternative fine of KSh 51 million.
