Nairobi – The Senate has begun to listen to the move to oust Kericho governor Eric Mutai.

On Wednesday, August 27, the session began with the Senate clerk, Jeremiah Nyegenye, reading the charges against the disputed governor as it was presented by the Kericho County Assembly.
What charges against Governor Eric Mutai?
Mutai’s charges include serious violations of the Constitution and other laws; Office abuse; and extreme discipline.
Basically, Mutai is charged with facilitating false payments of unsecured goods and services/exceeding the price of more than KSh 85 million.
The governor is also accused of misappropriation of Equalizer Labor Program (KSh 39 million) and the misuse of strategic intervention projects (such as the Kunaka Clinic).

On the basis of the abuse of the office, the governor is accused of illegal and fraudulent appointments.
In connection with the case of extreme misconduct, Mutai is charged, among others, using divisive, inappropriate language and undermining the respect of his office.
However, when he was asked to answer the charges Threethe controversial Kericho governor denied all charges against him.

In the earlier stage, the governor of Kericho filed a previous objection, claiming that no valid vote was held in the county parliament that would result in its removal.
Through his attorney, Katwa Kigen, Mutai claimed that the electronic voting system was at stake, noting that logging documents – salary clients as a username and identification number as a password – were available to the public.
Kigen gave records of audits and testimonials of Tehama experts showing some MCAs voted more than once, claiming the 2/3 rate was not fulfilled and the Senate authorities were not properly established.

As previously reported, Mutai is in the Senate for the second time, after he was killed for the first time in October 2024.
During the first removal, Mutai survived after 34 senators voted to oppose the motion, protesting the validity of the threshold used by the Kericho County parliament to sue him.
Only 10 senators supported the motion after Speaker Amason Kingi ordered the Senate to vote for the original objection on whether the parliament reached two -thirds of the majority of the votes needed.
Kingi said that the outcome of the vote concluded the process of removing Mutai.
