Constable bail request Kinzy Barasa has organized a heated legal struggle for his family’s challenges and government efforts to ensure justice is faced in court.

Barasa, who served at Kayole Police Station, has been brought to court on suspicion Boniface Mwangi Kariuki, who was shot closely.
Through an emergency document submitted to the Mountains High Court, Barasa requested the release of bail until his case began.
In her written statement, Barasa introduced herself as a family dependency on her wife, her two young children, and her sick mother.

He said in court that since he was detained, his family has been facing life’s challenges, with his children missing school regularly due to lack of fees.
His wife, who is unemployed, is alleged to have failed to pay taxes and food, and has threatened to leave him due to increased pressure.
“My family has been living in trouble every day. This pressure can break us and it will affect my children and my mother, who relies on my emergency medical help,” The officer said in court documents.
“Without bail given, the lives of my wife and mother will be completely destroyed, and justice will not be seen if the lives of those young children and her family will be destroyed,He added.
The defense, led by attorney Vincent Yegon, claimed that under section 49 (1) (h) of the Constitution, Barasa has the right to bail on reasonable terms.
They said he was not at risk of fleeing because he has permanent residence in Kayole, Nairobi, and Bungoma.

The attorneys also ensured the court that Barasa would comply with all the conditions given and attended the case without fail.
Why did Ipoa oppose Barasa’s bail request?
However, the Independent Police Audit Authority (IPOA) opposed the bail request.
In a statement written by Assistant Director of Investigation Sarah Mwea, the authority asked the court to put Barasa in prison, although the specific reasons for their opposition were not specified in the application documents.
Judge Lady Margaret Muigai ordered both parties to submit their arguments in writing before September 16, while making his decision whether the officer would remain in prison or be released on bail.
Did Barasa admit the offense?
In July, TUKO.co.ke reported that Barasa appeared in the mountainous courts to answer the murder charges, in which he filed an objection to a mistake before Magistrate Kanyi Kimondo.
The Barasa defense team asked for bail, insisting that it was not at risk of running and would follow the court orders. His attorneys said he was ready to cooperate with the legal process.
The prosecution called on the court to deprive them of bail, while showing the seriousness of the offense and the potential risks of witnesses.
