Nairobi – Former Deputy President Rigathi Gachagua He has suffered a major blow after the Supreme Court dismissed a request to overturn the swearing of his successor Kithure Kindiki.

On Thursday, July 31, a bench of three judges including judges Eric Ogola, Anthony Mrima, and Freda Mugambi announced that the events had passed the case filed on the request.

In their request, the Gachagua Lawyers team argued that Kindiki was sworn in on the basis of a decision made by a bench created illegally by Deputy Chief Justice Philomena Mwilu.

However, in his decision, a three -judgment bench stated that the appeal court’s decision made Gachagua’s application free.

“This application has been ignored by the events following the judgment of the Court of Appeal and the decision of this court,” Judge Murima said.

The former deputy president also suffered a crisis after three judges dismissed a request to get them out of the case.

Gachagua’s defense had opposed the bench membership, mentioning the membership due to the purchase of the forum.

However, the judges dismissed Gachagua’s attorneys’ argument, stating that the bench invasion was the administrative responsibility of the Chief Justice Martha Koome.

“Those decisions are on the record; therefore, it would be bad for us to argue about those decisions. If the decision is not clear, you know how to proceed. The bench transfer is the administrative responsibility of the Chief Justice. Judge Ogola decided.

The decision of the three judges’ bench now means that Kindiki is the deputy president of Kenya.

Gachagua, who previously abandoned the motivation to be returned to the office, is now seeking compensation.

Advocate Paul Muite had indicated that they would strongly oppose the constitutional legitimacy and legitimacy of Gachagua’s removal.

The veteran lawyer said they would try to persuade the judges to give Gachagua a tower that he would receive for five years as deputy president.

Among Gachagua’s applications is the KSh 1.2 million salary monthly, which will be translated into KSh 40 million.

He also wants to be restored safely and other retirement benefits related to the Deputy President’s office.

How did the Court of Appeal decide in the case of the removal of Gachagua

Initially reported by TUKO.co.ke, the Court of Appeal overturned a strong opposition to the DCJ in a case of dismissing the former deputy president.

The Court of Appeal agreed with Gachagua’s argument that Mwilu has no power to appoint a bench.
