Former Homa Bay County doctor has been instructed to return KSh 5.8 million of the salaries he received while doing a second secret job at a private hospital.

In a historic decision, Judge Bm Musyoki of the Mountains Anti -Corruption Court found Dr. Boniface Oloo Otiato is guilty of illegally benefiting from both public and private employment for three years.
The court ruled that Oloo must restore KSh 5,808,056.90 all he received from the Homa Bay County government between August 2017 and August 2020, as well as interest and legal costs.
“A statement is issued that the defendant benefited illegally and public funds of Kshs 5,808,056.90, paid as a salary by the Homabay County government. Thus, the judgment is given to the complainant for Kshs 5,808,056.90 and court interest rates from full payment date,” He said.
Why did the court decide against the Homa Bay doctor?
The ruling followed an investigation by the Ethics and Anti -Corruption Commission (EACC), which found that Oloo, despite being on the county payment list as a full -time medical officer, was at the same time working as Avenue Healthcare branch manager there Kisumu.
This process violated Article 77 (1) of the Constitution and section 26 of the Act of Leadership and Justice, which prohibits public servants from engaging in other beneficial jobs.

The evidence presented in court indicated that Oloo was sent to the Homa Bay County government in 2015.
He is said to have stopped reporting at work in August 2017 when he took office in Avenue Healthcare, but his county salary continued to be paid for three more years.
EACC investigator, Augustine Mukwekwe, told the court that Oloo’s name appeared in a 2020 audit targeting air workers, resulted in the commission’s investigation.
Using a warranty issued by the court, the EACC received Oloo Bank reports from the Kenyan Commercial Bank and confirmed that he continued to fetch his county’s salary until August 2020.
Should the Homa Bay doctor take more action?
Meanwhile, records from Avenue Healthcare and NHIF confirmed that he had been employed and later promoted to a private hospital during the period.
The court was also shown a letter of August 2021 in which Oloo accepted the payment twice and offered to return the money, an offer he had never followed.

Judge Musyoki noted that the case was not a special incident, highlighting that several similar cases are being dealt with from the same time.
“It is very concerned that the doctor can use the system when health care unions are pushing for better pay and staff. The judge said.
He also called for the responsibility of the crime to the employee and any county officials involved.
How will Kenya first deal with the delayers?
In a separate report, Secretary of the Public Service Cabinet Geoffreyruku announced a policy of completely intolerance of delays and absenteeism among public servants.
