Busia Senator Okiya Omtata has fingered the Directorate of Criminal Investigations (DCI) for the disappearance of activist Ndiangui Kinyagia.
In a statement on Wednesday, July 2, 2025, moments after visiting those injured during the June 25, 2025, protests, Omtatah demanded for the immediate release of the activist.
“Mr Ndiangui was branded a person of interest by the DCI. They even went to his home in Kinoo, Kiambu County yet today they claim he is not in their custody. Justice Chacha Mwita has now ordered them to produce him in court. We demand his immediate release, an explanation of his whereabouts, and that the court be allowed to determine if any detention is necessary and lawful. No Kenyan should vanish into the dark hands of the state. This is a republic governed by a Constitution, not by fear,” Omtatah stated.
“Every citizen has the right to due process and a fair hearing. That is not a privilege. It is the law. To every comrade, know this is a marathon. We have no two ways about it. We must win and we shall win. Go home in this struggle knowing you are not alone. We stand for every victim. We stand for every right. We stand for a Kenya where freedom breathes and no bullet, no intimidation, no cowardly abduction will break our will. Stay strong, stay brave, stay together. The struggle continues. The people shall prevail.”
DCI has reiterated that they did not arrest the missing Kinoo blogger Ndiangui Kinyagia, and he is not in their custody, nor do they know his whereabouts.
Appearing before Justice Chacha Mwita on Tuesday, July 1, 2025, lawyer Christopher Marwa, who was representing the DCI Director Mohammed Amin, told the court that they had not complied with the order that stated they produce the missing blogger.
“Your lordships, we have partially complied; what we have not been able to comply with is part of order five, which directed that my client produce the second petitioner (Kinyagia) in court today,” lawyer Marwa told the court.
However, lawyer Marwa told the court that there was no evidence that had been produced in court indicating that indeed the second petitioner (Kinyagia) was picked by his client.
He contested that the second petitioner’s lawyers have not placed any evidence in court showing the DCI picking the blogger from his residence.
“According to section 107 of the Evidence Act, your lordship demands that counsel appearing for the first and second petitioners (Law Society of Kenya and Kinyagia) do convince this court that indeed they saw or witnessed and confirmed my client, in particular the second respondent (DCI), as they picked the petitioner,” lawyer Marwa told the court.
Omtatah visits victims
While visiting victims of the June 25 protests, Omtatah says out of the 35 who had been injured and admitted to the Kenyatta National Hospital (KNH), 32 had been released.
“Yesterday I went to Kenyatta National Hospital to check on the progress of our brave comrades who were shot and injured while standing tall during the June 25 protests. Of the thirty-five who lay in those wards, only three remain. One has already been allowed to go home to heal, to find strength in the embrace of family, to remember that this nation does not forget its heroes,” he stated.
“They are holding on and so must we. I also sat beside the young man who took seven bullets, one of the four who shielded me from bullets. He came out of surgery alive, unbowed, unbroken. No bullet can silence the spirit of a free people. Even as we care for the wounded we must not turn a blind eye to the disappeared.”
