Court drama as activist condemns DCI stance on Kinyagia’s disappearance

Drama was witnessed at the Milimani High Court on Tuesday, July 1, 2025, when activist Mulinge Muteti rose to his feet during blogger Ndiangui Kinyagia’s case proceedings, condemning extrajudicial killings in the country.

Muteti rose in full of anger after the Directorate of Criminal Investigations (DCI) lawyer Christopher Marwa insisted in court that his client did not arrest the Kinoo blogger and also that they were not aware of his whereabouts.

The activist, through his action and a loud voice, caused a halt to the proceedings for a moment, where he vented by stating that the extrajudicial killings and disappearances of Kenyans must come to an end.

According to Muteti, the DCI lawyer was giving the court too many stories that were not adding up, adding that all that was required of them was to produce the blogger in court to ease the pain his family was going through due to his disappearance.

“We will not come here to listen to your stories. You have abducted someone; his family is crying, and you are here telling us stories. Enough is enough; extrajudicial killings and disappearances must end now. We must stop this madness; we must stop these evil things you are doing to us,” activist Muteti stated in court.

Additionally, Muteti, in his rant, stated that it is not right for the officers to abduct someone and not present them in court.

He argued that the same officers who were supposed to protect Kenyans have turned out to be the greatest threat to their security.

“Why should they abduct someone, and instead of producing them in court, they come here to start telling us stories about ‘I don’t know my client,’ ‘My client did this,’ ‘Your client what?’ Then what are we supposed to protect ourselves from when those who have turned out to be the greatest threat to our security? Muteti ranted in court.

The efforts of the security personnel to calm him down by requesting him to sit down for the court proceedings to proceed did not bear fruit after he responded that he should be allowed to speak, after which he would sit down.

Intervention

It took the intervention of lawyer Kibe Mungai for the activist to calm down and allow the court proceedings to proceed.

The DCI, through lawyer Christopher Marwa, had reiterated that they did not arrest Kinyagia, and he is not in their custody, nor do they know his whereabouts.

Further, Marwa told the court that they have a sworn affidavit that gives the account of what happened on the day the blogger got lost, noting that his client did not arrest him, and it is also in their interest that he be found.

“We have been able to give an account of what happened that resulted in the application that is before you, and in paragraph 20, my client, your lordship, has confirmed that they did not arrest the second petitioner, and so, your lordship, the second petitioner is not in the hands of my client,” lawyer Marwa told the court.
