The Law Society of Kenya (LSK) has filed a petition at the Milimani Constitutional and Human Rights Division, seeking orders compelling the State to produce Kinoo social media activist Ndiangui Kinyagia, dead or alive.
LSK wants the Inspector General of Police (IG) Douglas Kanja, the Director of the Directorate of Criminal Investigations (DCI) Mohamed Amin, the Interior Cabinet Secretary Kipchumba Murkomen and the Attorney General to produce the body of Kinyagia in court.
“Pending the hearing and determination of this application, an order be issued in the nature of habeas corpus to the respondents (IG, DCI, CS Ministry of Interior) to have the body of 2nd petitioner (Kinyagia) be produced immediately before the honourable court,” part of the petition read.
The LSK also wants the court to issue an order directing IG Kanja to appear before the court for the purposes of explaining the whereabouts of Kanyagia.
They are also seeking to have the court issue conservatory orders restraining the IG, DCI, and Ministry of Interior from arresting and holding Kanyagia incommunicado, without any due process as guaranteed under the law, following their illegal abduction.
They also want the court to issue orders directing the State to disclose the whereabouts of the social media activist.
According to the petition, Kinyagia, who is listed as the second petitioner, has been missing since he was abducted by the Inspector General of Police, the DCI and the Cabinet Secretary of the Ministry of Interior and National Administration.
“On June 21, 2025, the second petitioner (Kinyagia) was abducted by the 1st- 3rd respondents (IG and Interior CS) and until today, their whereabouts are unknown despite concrete efforts to trace them,” part of the petition reads.
The petition further states that his abduction came after he shared reservations against the State on various online social media platforms he owns and which have a substantial following.
LSK argues that Kinyagia was within the confines of Kenyan laws when he voiced his concerns on the current state affairs of the Country.
Additionally, they state that on the same day, Kinyagia was taken away by police officers who bundled him into a vehicle they had gone with at his place of residence in Kinoo and sped off.
“Plain-clothed police officers masked in balaclava, armed with handguns and driving 6-10 unmarked motor vehicles with distorted number plates abducted the 2nd petitioner (Kinyagia) at 1313 apartment in Kinoo along Nairobi-Nakuru highway, bundled him into a Subaru and sped off,” the petition adds.
