Former Chief Justice David Maraga has called for full accountability from the government over the death of activist and influencer Albert Ojwang.

The statement issued a bold and urgent call for the shutdown of President William Ruto’s administration, citing the death of Albert Omondi Ojwang in police custody as proof of a collapsing state.

In a strongly worded statement released on Tuesday, June 10, 2025, Maraga accused the regime of enabling lawlessness, brutality, and widespread human rights abuses.

State repression

Maraga has linked Ojwang’s killing to a broader pattern of state-sponsored violence, claiming that enforced disappearances and police killings have risen by 450 per cent over the past year.

“We refuse to be a country where parents have their children kidnapped in broad daylight, tortured, and killed by state-sponsored terror,” the statement read. “Albert’s murder is the last straw.”

The campaign accused the Ruto administration of treating citizens with contempt and ignoring constitutional values, stating that it had lost its legitimacy to govern.

Call for regime shutdown

Terming the current situation as a constitutional and moral crisis, Maraga demanded an immediate regime shutdown to allow for a national reset based on rule of law, human dignity, and institutional accountability.

“It is abundantly clear that this regime will not and cannot govern. We now demand the regime shut down and make way for a reset to the rule of law and accountability,” he added.

Autopsy findings

The statement referenced the findings of forensic pathologist Bernard Midia, who led a team of five experts in conducting the postmortem on Ojwang.

Speaking from Nairobi Funeral Home, Midia stated that Ojwang’s body bore injuries consistent with a physical struggle, contradicting police claims that Ojwang had fatally injured himself inside a police cell.

“When you combine all the injuries in the body, they are consistent with a struggle,” Midia said.

“The injuries were widespread across the body, including the head, back, and limbs. It is unlikely to be self-inflicted injury.”

Maraga cited this report as clear evidence of police brutality and extra-judicial killing, calling the official narrative a cover-up.
