A Nairobi court has released Kanyenyaini Ward Member of County Assembly (MCA) Grace Nduta, together with Juja Constituency Development Fund (CDF) Chairman Peter Mbari, David Macharia and Cyrus Kieru, on a Ksh1 million bond plus one surety of a similar amount.
The court has also given them each an alternative of paying a cash bail of Ksh300,000 plus two contact persons.
In her ruling, Milimani Magistrate Carolyne Nyaguthii has stated that she has not found any compelling reasons to detain the four.
“All the factors considered, I have found no existing reasons to detain the respondents in custody, I will grant the respondents a pre-charge bail but with conditions,” Magistrate Nyaguthii ruled.
The magistrate has barred the four from communicating with any defendants, either by themselves, their agents or through proxies.
Further, she has ordered them to report to the investigating officer weekly or whenever they are needed until the court directs otherwise.
She has also allowed the prosecution to apply for the cancellation of the bail terms granted in the event the four breach the conditions.
Meanwhile, she has dismissed the prosecution argument that the persons of interest may interfere with the ongoing investigations.
However, the magistrate noted that the court cannot ignore the fact that the charges facing the respondent are serious and promising to ensure that investigations are not jeopardised.
The Directorate of Criminal Investigation (DCI) had made a miscellaneous application on Friday, May 30, 2025, seeking to detain Mbari, Macharia, and Kieru for 15 days and MCA Nduta for 14 days to enable him to complete investigations.

In his application, the Investigative Officer (IO) Nicholas Njoroge stated that he needed the four to be detained to complete investigations in the alleged case of kidnapping in order to murder contrary to section 258 of the Penal Code.
He stated the need to investigate the four for creating disturbance in a manner likely to cause a breach of the peace contrary to section 95(1)(b) of the Penal Code.
Officer Njoroge said that he intends to probe them on giving false information to a person employed in the public service contrary to section 129(a) of the Penal Code.
While seeking their detention, Officer Njoroge told the court that if the four are released on bail, they might interfere with the ongoing investigations.
