The family of the late President Mwai Kibaki It ignored the allegations made by Jacob Ocholla, who says he is a Kibaki child of birth and wants the will to be declared invalid.
Ocholla says the will, on December 23, 2016, was forged and sought to be recognized as a legitimate successor.
However, Kibaki’s daughter, Judith Wanjiku, has asked the court to reject the case. He said it relies on allegations and opinions that have not been confirmed from Ms. Jnl, a woman who claims to be Kibaki’s daughter.
Judith said that Mrs. JNL is not an investigative or law expert, so his opinion does not have legal weight. He added that no approved writer had submitted an affidavit to prove forgery.
Kibaki also opposed an investigation report submitted by Ocholla, saying the person he was relying was not his author and could not give evidence about it.
He claimed the reports of the report, such as unusual space positions and signature diversity, were personal opinions, not professional results.
He also said the Ocholla case should be dismissed because it was submitted late, without court’s consent. The court had asked him to submit by November 28, 2024, but presented it on February 13, 2025.
Ocholla and Ms JNL, who presented the case in 2022, claim their mothers had a relationship with Kibaki in the 1950s. Earlier they had applied for the dismissal of the Kibaki body for DNA investigation, which the family opposed.
Ocholla’s lawyer, Omoke Morara, insists that the will is invalid because of the fraudulent signatures and lack of correct on each page. The case will be heard on June 26, 2026.

Gachagua also faces the burden of funding a national campaign without government resources.
