He dismissed the case accusing the police of illegally detaining him, despite previous allegations that his constitutional rights had been violated.
The decision was made during the hearing of High Court Judge Alexander Muteti in the Mountains Law Court.
Aroko, who is linked to the murder of the Kasipul MP, submitted the request through his attorney -led attorney Danstan Omari.
The request required the police to be forced to take him to court “Dead or alive,” Following concerns about where he is after being arrested.

He was finally brought to the Jomo Kenyatta International Airport (JKIA) legal court, where the judge ordered a seven -day detention order to allow detectives to complete the preliminary investigation. He is currently being detained at the Lilesshwa police station.
During the hearing, State Attorney Gichuhi, representing the Office of the Director of Public Prosecutions (ODPP), told the court that Aroko had been presented within the period set by the Constitution.
The judge accepted the statement and noted that there was no objection from the prosecution to demand that the request be removed.
“Since the complainant has expressed a willingness to withdraw the request, the court has no reason to oppose,” Judge Muteti decided.
He ordered Aroko to remain under police protection for seven days further investigation.
On Friday, May 9, the court had called the Inspector General of Police, Douglas Kanja, to explain why Aroch was not brought to court within 24 hours after his arrest, as required by the law.

According to investigative authorities, Arocho has been linked to the crime through communication and financial means.
Authorities claim he was directly involved in planning the killings, with evidence showing that several organizing meetings were held in Homa Bay, Nairobi, and Nakuru. The money transfer alleged to have been established by Arocho is believed to fund the crime.
The prosecution revealed that the deceased had reported threats from Arocho to the Office of the Director of Criminal Investigation (DCI).
They also emphasized that some Witnesses were now reluctant to testify, requesting 30 days to be detained to ensure their protection and allow further investigation. Despite these charges, Arocho opposed the prolonged restraint, citing his medical requirements and the importance of being close to his sick wife.
A strong critic and Were’s opponent
Aroko, also a prominent businessman, was a major opponent and critic of the killed MP.
He had repeatedly disputed him, thus sparking a political storm in a parliamentary constituency that has been described as fragile due to numerous chaos and political unrest.
Arocho’s relationship with the deceased made him a man of interest after the murder of the MP was announced.
However, he has separated from the allegations saying that although the late Were was his political opponent but he was also a friend.
In his condolences, Aroko said he was surprised and saddened by the brutal murder of Were and demanded that the investigation be done quickly to arrest the perpetrators.
