Why do Kalonzo, Malwa want Kindiki to resign?

Speaking to reporters, Wamalwa explained that the position of Kindiki was invalid following a court decision in the case of the removal of the former deputy president Rigathi Gachagua.

The Court of Appeal had overturned the decision of Deputy Chief Justice Philomena Mwilu to form a panel of three judges to listen to numerous requests to oppose the removal of Gachagua.

“You are in office illegally and, therefore, Deputy President Illegal. Do something honorable, Professor Kindiki, resign,” Wamalwa said.

Referring to the statements of the DAP-K leader, Kalonzo said the country now seems to have two presidential deputies, suggesting that this is impossible, as the nation can have only one second.

He added that the resignation of the stream would allow the proper process to be implemented following the decision of the Court of Appeal in the Gachaea case.

“The decision of the Court of Appeal has clearly shown the illegality and political crisis involved in the attempts to demand that the deputy president,” He said.

The party leader argued that it was now openly removed from the office in Gachaea.

He explained that the court’s decision to overturn Mwilu’s action to form a three -judgment bench means the whole process of removing them is invalid.

“The whole thing is invalid,” He said.

This came after the Court of Appeal ordered the Chief Justice Martha Koome Creating a new panel of judges who will listen and decide the case of Gachagua in the Supreme Court.

A panel of three judges, led by Francis Tuiyott, Daniel Musinga, and Mumbi Ngugi, mentioned that Koome must start a new bench within 14 days.

The decision came after several complainants asked for a separate panel to listen to the case.

They claimed their right to be heard was violated when the first three judges’ bench in Kerugoya refused to resign despite allegations of bias and conflict of interest, which was said to affect their impartiality.

One request submitted by activist Enock Aura through his attorney Harrison Kinyanjui, called for the existence of a bench of five judges, saying the case raised important legal issues that required a larger panel.

The appeals were about whether the Deputy Chief Justice had a constitutional authority to form the Kerugoya bench, which refused to prevent the swearing -in of Kindiki.
