The request was submitted by three people, Owiso Owiso, Khelef Khalifa, and Ashioya Biko, who question that the Constitution clearly states when the presidential election should be made.
In accordance with Article 136 (2) (a) of the Constitution, the presidential election must be held on the second Tuesday of August fifth after the last general election.
Since the previous election was held on August 9, 2022, the complainants question that the next one should be on August 11, 2026.
They ask the court to confirm that the fifth year officially begins on August 9, 2026.
Making elections at any time after the second Tuesday of the month, they are questioning, it will be unconstitutional and may make the whole election process invalid.
Owiso, one of the complainants, emphasized that the Constitution is clear and should be carefully followed.
The group also indicated that Kenyan courts have made a decision on similar issues, thus emphasizing the importance of considering the constitutional time.
