Veteran Lawyer John Khaminwa Grows Like Andazi In Court, Scolds Githu Muigai: “Sit Down I'll Talk”

Nairobi – Veteran lawyer John Khaminwa brought laughter to the lawyers at the Milimani Court when he protested the time allotted to the lawyers opposing the impeachment of the sacked vice president Rigathi Gachagua.

What offended lawyer John Khaminwa in court?

Lawyer Githu Muigai asked Khaminwa to observe court procedures, which dictate that the attorney general must speak before anyone else, except the Attorney General.

However, Khaminwa rejected the request and insisted that the lawyers be given enough time to discuss their arguments, especially due to the current constitutional crisis in the country.

“Will you stay while I'm still talking? I won't stay. When I was enforcing the law, you were still breastfeeding. The country is in a constitutional crisis. It's a national crisis. With all due respect, this is not something that should be allocated 10 minutes or 20 minutes. That's not appropriate .Let these lawyers do the talking.

According to Khaminwa, there is no urgency to hear the case, and thus, the issue of time should not be a concern.

Why the case to remove Gachagua from office should not be expedited

He said that sufficient time is important for the lawyers to explain their positions, as suing the vice president is an important issue.

He emphasized that since the discussions to indict him began; the country has been in a state of paralysis, insisting that the parties need time to recover, which can only happen if they are allowed to express their opinions fully.

“Forget about the concept of time, what are we rushing for? This has crippled the nation, it is a serious matter. The prosecution of the vice president is not a small matter. Let the professors be given the time they want. That is the healing process,” he continued to explain.

Khaminwa has also asked that the titles used in the court be set aside and the current issue given priority.

Gachagua accuses the 3-judge bench of bias

Before the hearing of the case, Rigathi Gachagua's legal team accused the three-judge bench of bias in handling his case. They claimed that the judges met on Saturday, October 19, and set the hearing date without informing them or involving them.

The legal representatives also noted that the court had previously informed them that the earliest date for the case was October 29.

However, following the request of the respondent, a new date was quickly arranged and moved to Tuesday, October 22. Furthermore, they claimed that the Chief Justice Martha Koome he was not in the country to form the bench properly.
